At Choice MedWaste, we're at the forefront of understanding rules dictating medical waste disposal in Maryland. We provide solutions that help ensure healthcare facilities across the state remain in compliance with regulations in addition to contributing positively to our environment.
The state has set forth stringent guidelines through the Code of Maryland Regulations 10.06.06, which meticulously defines medical waste and outlines the responsibilities for its treatment, storage, disposal, and transportation.
That's why, as your dedicated partner in medical waste management, Choice MedWaste is here to guide you.
First Things First: Federal and State Medical Disposal Regulations
The EPA focuses on the environmental impact of hazardous waste. They enforce the Resource Conservation and Recovery Act (RCRA) to ensure that these types of waste are treated, stored, and disposed of properly. They don't just tell you how to throw it away, they also encourage strategies to reduce waste in the first place.
OSHA, on the other hand, is all about worker safety, emphasizing both the importance of identifying risks as well as employing protective measures. They have strict rules for labeling and packaging to minimize risks during handling and transport. Furthermore, they also mandate comprehensive training and planning to minimize our workers' exposure to any hazardous materials.
What You Need To Know: Maryland Infectious/MedicalWaste Regulations
Segregation and Disposal
Waste should be segregated at its source into distinct categories, such as sharps, pathological waste, or pharmaceutical waste.
Sharps, for example, can't just be thrown away – they need to be autoclaved or incinerated before final disposal.
Similarly, pharmaceutical waste, such as expired medications, unwanted antibiotics, and unused chemotherapy drugs, demands specialized handling to prevent any adverse effects on our surroundings.
Packaging
Containers used for sharps must be puncture-resistant and leak-proof to prevent injuries and contamination during both transportation and disposal. Maryland Department of Environment (MDE) even has specific rules about these containers, like having a fill line to avoid cramming them too full and ensuring they're securely closed before disposal.
Each container must also be conspicuously labeled as “Medical Waste,” featuring the biohazard symbol for easy identification. On top of that, they must also include the generator's name, address, and type of waste to make things even clearer.
Tracking
A shipping paper will follow each pick up of medical waste that identifies the waste type, container counts and generator information until the waste is fully treated. These shipping papers are sometimes called manifests with our healthcare clients. A copy of your shipping paper/manifest will be sent with your invoice or can be accessed via our client portal.
You can visit the Maryland Department of the Environment for more detailed regulations.
Penalties for Non-Compliance With Maryland Medical Waste Disposal Regulations
Financial Implications
The cost for non-compliance isn't just a slap on the wrist. Depending on how serious or frequent, you could be looking at fines that range from just a few hundred bucks to eye-watering sums in the tens of thousands for bigger violations or if it looks like you’re making a habit of it.
Operational Disruptions
Consequences for infractions can mean the temporary closure of facilities or specific departments until compliance is restored. Not only does this throw a wrench in your day-to-day operations, but it also means patients might not get the care they need when they need it.
Talk about a headache for everyone involved.
Legal Repercussions
These will not only drain financial resources but also consume time, focus, and resources–all of which are better spent on patient care and keeping your facility running smoothly.
It's pretty much the opposite of where you want your energy to go.
Reputation Damage
This is huge because once trust is broken, it is hard to rebuild.
Any violations can seriously tarnish your relationships - not just with patients, but also partners, suppliers, and regulatory bodies. In the worst-case scenario, it could also mean waving goodbye to future golden opportunities or collaborations, too.
